Terms and Conditions:

PLEASE READ THESE TERMS AND CONDITIONS OF SALE (“SALE AGREEMENT”) VERY CAREFULLY. THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS (UNLESS THE CUSTOMER HAS SIGNED A SEPARATE FORMAL PURCHASE AGREEMENT WITH CLEAR IMAGE SOLUTIONS, LLC, IN WHICH CASE THE SEPARATE AGREEMENT SHALL GOVERN).

SALE AGREEMENT:

This Sale Agreement is a legal contract between the Customer and Clear Image Solutions, LLC. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. (References to “you” or “your” shall relate to the Customer; references to “Clear Image Solutions, LLC” shall relate to Clear Image Solutions, LLC and its affiliates.) The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question.

This Sale Agreement constitutes the entire agreement between the Customer and Clear Image Solutions, LLC relating to the purchase or sale of goods or services on the Site. The Sale Agreement may only be modified or terminated with regard to goods or services that have been purchased or sold on the Site in a writing signed by Clear Image Solutions, LLC. Electronic records (including signatures), that are otherwise valid shall be accepted under the Sale Agreement. The Customer consents to receiving electronic records, which may be provided via a web browser or e-mail application connected to the Internet; consumers may withdraw consent to receiving electronic records or have the record provided in non-electronic form by contacting Clear Image Solutions, LLC at the address provided below.

In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sale Agreement and our invoice shall control.

GOVERNING LAW:

THIS AGREEMENT AND ANY SALES HERE UNDER SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TENNESSEE, WITHOUT REGARD TO CONFLICTS OF LAWS RULES. THE CUSTOMER CONSENTS TO THE JURISDICTION OF THE FEDERAL OR STATE COURTS LOCATED IN KNOX COUNTY, TENNESSEE FOR PURPOSES OF ANY SUIT ACTION OR PROCEEDING ARISING OUT OF THIS SALE AGREEMENT.

RISK OF LOSS:

Title to goods herein being purchased passes to the purchaser upon delivery of the goods to the purchaser, unless otherwise specified. Loss or damage that occurs during shipping by a carrier is Clear Image Solutions, LLC’s responsibility.

CLEAR IMAGE SOLUTIONS, LLC HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER BY CLEAR IMAGE SOLUTIONS, LLC IN NO WAY AFFECTS THE TERMS OF THE MANUFACTURER’S WARRANTY, IF ANY.

PRICING AND INFORMATION DISCLAIMER:

All pricing subject to change without notice. For all prices, products and offers, Clear Image Solutions, LLC reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances. While Clear Image Solutions, LLC uses reasonable efforts to include accurate and up-to-date information on the Site, Clear Image Solutions, LLC makes no warranties or representations as to the Site’s accuracy. Clear Image Solutions, LLC assumes no liability or responsibility for any errors or omissions in the content on the Site.

CANCELLATION AND ORDER CHANGE FEES:

We invest time and money to prepare every order that is placed on our site, even before the order ships. After you have placed your order online, or over the phone with a sales associate you will be charged 10% Cancellation/Change fee if you decide to cancel the order or substitute products. You will not be charged any additional fee for adding items to an existing order. By placing an order online or making a phone order with a sales associate you agree to pay this 10% Cancellation/Change fee should you cancel or change your order. Our business is not set up to change orders easily. We apologize for having to implement these changes, but it is necessary in order to keep our prices low for our customers.

ITEM AVAILABILITY:

Occasionally we have only one item in stock and more than one person orders it. We will honor the first funded order. If we run out of stock we will cancel your order and refund your money. 

If you do not pay with credit card or ACH we do not hold items from your order. Consequently, if someone else with guaranteed funds buys the same item it may become unavailable and we cannot ship one to you. Once you place an order with us we will set your items aside with your name on them ONLY after your order is funded. This is our only way to know you are serious about the order. If you do send us a check or money order and we sell the item to someone else, we will return and void your personal check or mail you a refund check. 

ONLINE PRICE AND DESCRIPTION ERRORS:

Our online inventory changes every day. Occasionally an item may appear on the site by mistake or the item’s description may contain a typographical error. We do not guarantee that titles, descriptions or pictures on our site are error-free. We reserve the right to refuse any order including but not limited to orders for items with errors in the description or price. In the event that we cancel an order we will not charge the customer’s credit card or we will return the money.

If an item’s description contains an error such as incorrect price and a customer orders one, we will not process the order without first contacting the customer. If the order is mistakenly shipped, we may advise the customer to return the item in an unopened condition and we will not bill the customer. By placing an order, the customer agrees that Clear Image Solutions, LLC will be the final arbiter of discrepancies in the online catalog.

LIMITATION OF LIABILITY:

Clear Image Solutions, LLC will not be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. Clear Image Solutions, LLC will not be liable for products or services not being available for use or for lost or corrupted data or software. Customer agrees that for any liability related to the purchase of products or services, Clear Image Solutions, LLC is not liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase(s) under this agreement.

It is the responsibility of the buyer, not Clear Image Solutions, LLC to ascertain and obey all applicable local, state and federal laws in regard to the possession and use of any item purchased from Clear Image Solutions, LLC. All products are sold upon the condition that we, the seller, shall not be liable in any action for the arrest, accident, or injury occasioned during the transportation, handling, storage, sale, or use of the merchandise. Consult your local and state laws before ordering if you are in doubt. Absolutely no sales will be made to minors. By placing an order, the buyer represents that the products ordered will be used in a lawful manner and that he/she is of legal age. Clear Image Solutions, LLC or any of its employees will not be held liable for the misuse of any product purchased from us. When you purchase an item from Clear Image Solutions, LLC, you release Clear Image Solutions, LLC and any or all of their employees of any liability regarding your actions concerning the sale, use, ownership and shipping of any products ordered.

BUYER’S ASSUMPTION OF RESPONSIBILITY:

Like many other items we use, when used improperly firearms can be dangerous. By purchasing through this system you agree to follow all manufacturer  instructions and to only use the product in a safe manner in an approved area for a legal purpose.

  • YOU are assuming all responsibility for the legality of a specific item when you purchase it.
  • YOU are responsible for checking all local laws before ordering or using an item from Clear Image Solutions, LLC or any manufacturer whose product is sold here.
  • YOU are responsible for complying with all firearms laws in your area.
  • YOU must notify us immediately should you have any concerns about the legality of any product you have ordered.
  • YOU are responsible for payment for all orders placed through this online system. If you are not sure if you want something – do not order it.
  • YOU must be of legal age to own any items you order.
  • YOU must be at least 18 years of age to purchase ANY item from Clear Image Solutions, LLC. Clear Image Solutions, LLC may request a copy of your state identification before shipping your order.
  • YOU must provide a valid contact phone number with any order placed. Clear Image Solutions, LLC may contact you at the provided phone number before processing any order.

ITAR (International Traffic in Arms Regulations) AND EAR (Export Administration Regulations) COMPLIANCE STATEMENT:

By ordering any product(s) from Clear Image Solutions, LLC website, you certify that you, or third-party entities at your direction, will not sell, transport, ship or transfer outside the borders of the United States, nor to any foreign person*, any product(s) which are export-restricted by U.S. export-control law and regulation, without proper U.S. Government export authorization, licensing, and documentation. 

Export-restricted items include, but are not limited to, firearms, ammunition, electronic equipment, certain gear and firearm accessories, weapon-mounted or handheld optical equipment including rifle or handgun scopes, night vision and night vision accessories, holographic sight systems, “red-dot” optics, thermal vision, and tactical lights and lasers, knives, and body armor including vests, helmets and shields.

You must indicate on your order if you intend for an item(s) to be exported.  An indication of desire of exportation in no way compels Clear Image Solutions, LLC to assist with export in any way, before or after purchase of an item(s).  Export, or attempt to export, any controlled or prohibited items outside of the U.S. without complying with U.S. export control regulations can result in severe civil and criminal penalties and/or constitute a federal crime.  Clear Image Solutions, LLC will not participate in any transaction, directly or indirectly, involving the illegal export or re-export of any prohibited items.

 * “Foreign Person” under ITAR § 120.16 means “any natural person who is not a lawful permanent resident as defined by 8 U.S.C. § 1101 (a)(20) or who is not a protected individual as defined by 8 U.S.C. § 1324b(a)(3)”, and can mean “any foreign corporation, business association, trust, society, or any other entity or group that is not incorporated or organized to do business in the U.S., as well as international organizations, foreign governments, and any agency or subdivisions of government (e.g. diplomatic missions).”

BUYER’S REPRESENTATIONS AND WARRANTIES:

  • YOU are not prohibited by Federal or State law, or local ordinance, from receiving firearms or firearm components, of any kind.
  • YOU are at least eighteen (18) years of age .
  • YOU are the actual transferee/buyer of the product you are purchasing from Clear Image Solutions, LLC.
  • YOU are not under indictment or information in any court for a felony, or any other crime, for which the judge could imprison you for more than one year.
  • YOU have not been convicted in any court of a felony, or any other crime, for which the judge could have imprisoned you for more than one year, even if you received a shorter sentence including probation.
  • YOU are not a fugitive from justice.
  • YOU are not an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance.
  • YOU have not been adjudicated mentally defective (which includes a determination by a court, board, commission, or other lawful authority that you are a danger to yourself or to others or are incompetent to manage your own affairs) OR have not been committed to a mental institution?
  • YOU have not been discharged from the Armed Forces under dishonorable conditions.
  • YOU are not subject to a court order restraining you from harassing, stalking, or threatening your child or an intimate partner or child of such partner.
  • YOU have not been convicted in any court of a misdemeanor crime of domestic violence.
  • YOU have never renounced your United States citizenship.
  • YOU are not an alien illegally in the United States.
  • YOU are not currently on Federal NICS or State agency “DELAY” OR “DENIED” status regarding your most recent attempt to purchase a firearm.  Firearm AND/OR ammunition or ammunition component sales or transfers are prohibited during these conditions.
  • YOU understand that handling, cleaning, or discharging fireams, ammunition or ammunition components may cause exposure to lead, and YOU hold Clear Image Solutions, LLC harmless and YOU assume all responsibility for any lead exposure.

Clear Image Solutions, LLC decorative designs are all original art and as such, are protected by United States and International copyright laws. All rights are reserved. Copying, depiction, reproduction, modification, distribution, display, performance or transmittal for any purpose of Clear Image Solutions, LLC product designs is prohibited under United States and international copyright laws.

TRADEMARKS:

Clear Image Solutions, LLC is the owner of all trademarks regardless if they are registered or not. All registered trademarks are registered in the United States of America and other countries.

PATENTS:

Products and/or designs shown and/or described by this Site may be subject to one or more U.S. and International Patents. Clear Image Solutions, LLC owns Patents filed with and granted by the U.S. Patent & Trademark Office.

INTELLECTUAL PROPERTY VIOLATIONS:

Unauthorized use of Clear Image Solutions, LLC intellectual property is expressly prohibited and may be a violation of law, and subject to prosecution. Clear Image Solutions, LLC will go to great lengths to protect its intellectual property including patent, trademark and copyright infringement actions and all other available remedies under applicable laws.

ORDERS; PAYMENT TERMS; INTEREST; TAXES:

Orders are not binding upon Clear Image Solutions, LLC until accepted by Clear Image Solutions, LLC. Terms of payment are within Clear Image Solutions, LLC’s sole discretion. Invoices are due and payable within the time period noted on the invoice, measured from the date of the invoice. Clear Image Solutions, LLC may invoice parts of an order separately. Customer agrees to pay interest on all past-due sums at the highest rate allowed by law. The Customer is responsible for sales and all other taxes associated with the order. Clear Image Solutions, LLC collects 9.25% sales tax on all orders placed by Tennessee residents.

PAYMENT METHODS:

We accept all major credit cards and process all of our transactions through Paypal or Authorize.net. Our eCommerce solution is PCI compliant and provides the highest level of consumer data protection and exceptional buyer and seller fraud protection. No credit card information is retained in our database and will be deleted upon completion of transaction and expiration of return period.
